INTRODUCTION​

New England Patriots LLC ("Company" or "We") respects your privacy and is committed to protecting it through compliance with this policy.

This policy describes the types of information we may collect from you or that you may provide when you visit our website www.patriots.com (our "Website"), use our mobile applications, and any online services that link to or post this Privacy Policy (collectively, the "Services"). It describes our practices for collecting, using, maintaining, protecting and disclosing that information. Please note that this Privacy Policy does not apply to any information that is collected or obtained through sites or services that do not link to this Privacy Policy (including the Pro Shop) or information collected by the NFL or the other NFL member clubs (the "Member Clubs").

This policy applies to information we collect:

  • Through mobile and desktop applications you download through the Services, which provide dedicated non-browser-based interaction between you and the Services; and

Please note that the Services are directed towards users who reside in the United States. By using the Services, you consent to the collection, storage, processing, and transfer of your information in and to the United States, or other countries and territories, pursuant to the laws of the United States. CHILDREN UNDER THE AGE OF 13

The Services are not intended for children under 13 years of age. No one under age 13 may provide any information to or on the Services. We do not knowingly collect personal information from children under 13. INFORMATION WE COLLECT ABOUT YOU AND HOW WE COLLECT IT

We may collect several types of information from and about users of the Services, including information:

  • By which you may be personally identified, such as name, postal address, e-mail address, telephone number, or any other identifier by which you may be contacted online or offline ("personal information");
  • That is about you but individually does not identify you;
  • About your internet connection, the equipment you use to access the Services and usage details, such as operating system version and type and device carrier;
  • About your demographics, such as gender and date of birth or age;
  • About your geolocation;
  • About your communications preferences;
  • About your search queries;
  • Regarding comments and other information posted on our interactive online forums;
  • Regarding correspondence and other information that you send to us; and

We may collect this information:

  • Directly from you when you provide it to us.
  • Automatically as you navigate through the site. Information collected automatically may include usage details, IP addresses and information collected through cookies, web beacons, and other unique identifiers, including mobile device identification numbers, your browser type, sites you visited before and after visiting the Services, pages you view and links you click on within the Services and standard server log information; and
  • From third parties, including our marketing our business partners.

INFORMATION YOU PROVIDE TO US

The information we collect on or through the Services may include:

  • Information that you provide by filling in forms. This includes information provided at the time of registering or subscribing to use the Services and posting material or requesting further services. We may also ask you for information when you enter a contest or promotion sponsored by us, and when you report a problem with the Services;
  • Records and copies of your correspondence (including e-mail addresses), if you contact us;
  • Your responses to surveys that we might ask you to complete for research purposes;
  • Details of transactions you carry out through the Services and of the fulfillment of your orders. You may be required to provide financial information before placing an order through the Services; and
  • Your search queries on the Services.

You also may provide information to be published or displayed (hereinafter, "posted") on public areas of the Services, or transmitted to other users of the Services or third parties (collectively, "User Contributions"). Your User Contributions are posted on the Services and transmitted to others at your own risk. Please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of other users of the Services with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.

INFORMATION WE COLLECT THROUGH AUTOMATIC DATA COLLECTION TECHNOLOGIES

As you navigate through and interact with the Services, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions and patterns, including:

  • Details of your visits to the Services, including traffic data, location data, logs, and other communication data and the resources that you access and use on the Services;
  • Information about how often you use an application, the events that occur within the application, aggregated usage and performance data, and where an application was downloaded from; and
  • Information about your computer and internet connection, including your IP address, operating system and browser type.

  • Store information about your preferences, allowing us to customize the Services according to your individual interests;
  • Speed up your searches; and
  • Recognize you when you return to the Services.

We and our partners (e.g., marketing sponsors), affiliates, or analytics or service providers (e.g., online customer support provider) use technologies such as cookies, beacons, tags and scripts to analyze trends, administer the Services, track users' movements around the Services and to gather demographic information about our user base as a whole. We may receive reports based on the use of these technologies by these companies on an individual and aggregated basis. The technologies we use for this automatic data collection may include:

  • Cookies (or Browser Cookies). A cookie is a small file placed on the hard drive of your computer. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting you may be unable to access certain parts of the Services.   • Local Shared Objects. Certain features of the Services may use local shared objects, such as Flash cookies, and Local Storage, such as HTML5, to collect and store information about your preferences and navigation to, from and on the Services. Third parties with whom we partner to provide certain features on the Services or to display advertising based upon your web browsing activity also use HTML5 to collect and store information.   • Web Beacons.The Services and our e-mails may contain small electronic files known as web beacons (also referred to as clear gifs. pixel tags and single-pixel gifs) that permit the Company, for example, to count users who have used the Services or opened an e-mail and for other related statistics (for example, recording the popularity of certain content and verifying system and server integrity).
  • Social Media Features and Widgets. The Services may include Social Media Features, such as the Facebook Like button, and Widgets, such as the Share This button or interactive mini-programs, that run on the Services. These Features may collect your Internet protocol address, which content you are visiting and may set a cookie to enable the Feature to function properly. Social Media Features and Widgets are either hosted by a third party or hosted directly on the Services. Your interactions with these Features are governed by the privacy statement of the company providing it.

INFORMATION COLLECTED BY GOOGLE ANALYTICS

We may use Google Analytics to understand how you make use of our content and determine how we can ensure that the Services function properly. Google Analytics cookies follow your progress through the Services, collecting anonymous data on where you have come from, what content you visit and the time spent using the Services. This data is stored by Google in order to create reports. These cookies do not store your personal data.

THIRD-PARTY USE OF COOKIES AND OTHER TRACKING TECHNOLOGIES

HOW WE USE YOUR INFORMATION

We use information that we collect about you or that you provide to us, including any personal information:

  • To present the Services and their content to you;
  • To provide you with information about products, contests, sweepstakes, events or services that you request from us;
  • To publish stories, comments, photos and other information posted in our interactive online features;
  • To provide you with notices about your account/subscription, including expiration and renewal notices;
  • To help you locate a place you may be searching for in your area. We will only share this information with our mapping provider for the sole purpose of providing this service;
  • To send you push notifications from time-to-time in order to update you about any events or promotions that we may be running;

  • To our parent organizations, subsidiaries and affiliates, and with all members of the NFL Family, including, without limitation, NFL Properties LLC, NFL International LLC, NFL Enterprises LLC, NFL Ventures, L.P. and NFL Ventures, Inc.;
  • To contractors, service providers and other third parties we use to support our business and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them, including sending e-mails and notifications, analyzing data, providing marketing, event, and order assistance, and/or providing customer service and support;
  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution or other sale or transfer of some or all of New England Patriots LLC's assets, whether as a going concern or as part of bankruptcy, liquidation or similar proceeding in which personal information held by New England Patriots LLC about users of the Services is among the assets transferred;
  • To third parties to market their products or services to you if you have consented to/not opted out of these disclosures. CHOICES ABOUT HOW WE USE AND DISCLOSE YOUR INFORMATION

We strive to provide you with choices regarding the personal information you provide to us. We have created mechanisms to provide you with the following control over your information:

For this opt-out to function, you must have your browser set to accept browser cookies.
  • Disclosure of Your Information for Third-Party Advertising. If you do not want us to share your personal information with unaffiliated or non-agent third parties for promotional purposes, you can opt-out by checking the relevant box located on the form on which we collect your information. You may also opt-out by adjusting your user preferences in your account profile by checking or unchecking the relevant boxes or by sending us an e-mail stating your request to web@patriots.com.
  • Promotional Offers from the Company. If you do not wish to have your contact information used by the Company to promote our own or third parties' products or services, you can opt-out by checking the relevant box located on the form on which we collect your data or at any other time by adjusting your user preferences in your account profile by checking or unchecking the relevant boxes or by sending us an e-mail stating your request to web@patriots.com. If we have sent you a promotional e-mail, you may send us a return e-mail asking to be omitted from future e-mail distributions. This opt out does not apply to information provided to the Company as a result of a product purchase, warranty registration, product service experience or other transactions.
  • Newsletter. You may choose to stop receiving our newsletter or marketing emails by following the unsubscribe instructions included in these emails, accessing the email preferences in your account settings page, or you can contact us at web@patriots.com.
  • Location Based Services. You may opt-out of location based services at any time by editing the setting at the device level or by emailing us at web@patriots.com.
  • Push Notifications. If you no longer wish to receive push notifications, you may turn them off at the device level. To ensure you receive proper notifications, we will need to collect certain information about your device such as the operating system and user identification information.

We recommend that you ensure that your internet browser is up-to-date and that you consult the help and guidance provided by the developer of your internet browser if you are unsure about adjusting your privacy settings. In addition, although we do not utilize targeted advertising and do not control third parties collection or use of your info, you can opt out of receiving targeted advertisements generally from members of the Network Advertising Initiative ("NAI") by visiting their website.

ACCESSING AND CORRECTING YOUR INFORMATION

You can review and change your personal information by visiting your account profile page.

You may also send us an e-mail at web@patriots.com to request access to, correct or delete any personal information that you have provided to us. We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect. We will respond to your request within a reasonable timeframe.

If you delete your User Contributions from the Services, copies of your User Contributions may remain viewable in cached and archived pages, or might have been copied or stored by other users of the Services. Proper access and use of information provided on the Services, including User Contributions, is governed by our terms of use.

YOUR CALIFORNIA PRIVACY RIGHTS

California Civil Code Section § 1798.83 permits users of the Services that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. DATA SECURITY
